You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason.   • Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats ("gifs"), 1×1 pixels, web bugs, cookies, or other similar devices
  • Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site
  • Use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site

Harmful and Illegal Content Generation:

Users are strictly prohibited from using our AI generation services to create, attempt to create, or request content that:

  • Promotes violence, terrorism, or generates hateful content that discriminates or threatens protected groups based on gender, ethnicity, sexual identity, orientation, religion, or other characteristics
  • Involves exploitation or harm to children, including solicitation, creation, acquisition, or dissemination of child exploitative content
  • Provides encouragement or instructions related to self-harm or suicide
  • Promotes human trafficking, exploitation, and sexual violence
  • Constitutes harassment, abuse, threats, stalking, or bullying of individuals or groups
  • Creates non-consensual nudity or illegal pornographic content
  • Generates extreme gore, images involving bodily destruction, mutilation, torture, or animal abuse
  • Facilitates discrimination in employment, housing, credit, or other essential services based on protected characteristics
  • Creates malicious code, malware, computer viruses, or activities that could disable or impair computer systems

Deceptive and Misleading Activities:

  • Intentionally deceive or mislead others, including generating, promoting, or furthering fraud or disinformation
  • Generate defamatory content, including defamatory statements, images, or other materials
  • Impersonate another individual without consent, authorization, or legal right
  • Misrepresent AI-generated content as human-generated
  • Generate false online engagement, fake reviews, or other deceptive practices
  • Create or distribute large-scale disinformation campaigns
  • Generate political advertisements, propaganda, or influence campaigns

Intellectual Property and Legal Compliance:

  • Delete the copyright or other proprietary rights notice from any Content
  • Copy or adapt the Site's software, including but not limited to Flash, PHP, HTML, JavaScript, or other code
  • Use any information obtained from the Site in order to harass, abuse, or harm another person
  • Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site
  • Use the Site in a manner inconsistent with any applicable laws or regulations
  • Attempt to circumvent our content filtering and safety systems
  • Use the Site for any purpose that violates the rights of others or applicable laws

4. Content Generation, Data Handling, and User Responsibility

4.1 Data Processing and Storage Policies

No Data Storage by AI Free Forever: AI Free Forever does not store, retain, or keep any uploaded content, user inputs, prompts, or generated content on our servers or systems. All data processing is handled on a session-by-session basis without permanent retention.

Third-Party Processing: Uploaded data and prompts may be temporarily transmitted to third-party AI service providers (including but not limited to Replicate) solely for the purpose of generating the requested content. This transmission occurs only during active processing and is not stored by AI Free Forever.

Replicate Storage Policy: Generated images processed through Replicate's services may be temporarily stored on Replicate's servers for a maximum period of one (1) hour, after which they are automatically and permanently deleted from their platform.

Session-Based Processing: All interactions with our AI tools operate on a real-time, session-based model. Once your browser session ends or you navigate away from generated content, no record of your inputs or outputs remains on our systems.

4.2 Content Filtering Systems

We maintain automated content filtering and safety systems designed to prevent the generation of inappropriate, harmful, or illegal content. These systems are designed to block requests for prohibited content and ensure generated output meets appropriate standards.

4.3 User Responsibility and Liability

Sole User Responsibility: You acknowledge and agree that you are solely and entirely responsible for any content you upload, generate, request, share, distribute, or otherwise make available through our services. This responsibility extends to all uploaded data and generated content regardless of whether our filtering systems detect or block inappropriate requests.

Uploaded Content Liability: You are fully responsible for ensuring that any data, images, files, or other content you upload to our services:

  • Is legally owned by you or used with proper authorization
  • Does not violate any applicable laws or regulations
  • Does not infringe upon third-party intellectual property rights
  • Does not contain harmful, illegal, or inappropriate material
  • Complies with all content standards outlined in these Terms

Circumvention Attempts: While we maintain content filtering systems, users who attempt to circumvent, bypass, or manipulate these systems through creative prompting, indirect requests, uploaded content, or other means do so at their own risk and remain fully liable for any resulting content.

Content Liability: You expressly agree that AI Free Forever, Quick Flip Services, and their affiliates bear no responsibility or liability for:

  • Any content you upload or generate using our AI tools
  • Any use, distribution, or sharing of uploaded or generated content
  • Any legal, social, or personal consequences arising from your uploaded or generated content
  • Any attempts to circumvent our content safety systems
  • Any inappropriate, harmful, offensive, or illegal content that may be processed or generated despite our filtering systems

4.4 Generated Content Standards

Even with our filtering systems in place, you agree that any content you upload or generate will:

  • Comply with all applicable laws in your jurisdiction
  • Respect the rights and dignity of others
  • Not violate any intellectual property rights
  • Not be used for harmful, illegal, or unethical purposes
  • Be subject to your own review and judgment before use or distribution

By using our content generation services, you acknowledge that AI systems may occasionally produce unexpected or inappropriate outputs, and you accept full responsibility for reviewing and managing any content you upload or generate.

5. Content Ownership and Intellectual Property Rights

5.1 User-Generated and Uploaded Content Ownership

Complete User Ownership: You retain all rights, title, and interest, including copyright and other intellectual property rights, to all content you upload and generate using our AI tools. We make no claims to ownership of your uploaded or generated content.

No Content Retention: AI Free Forever does not store, retain, access, or maintain copies of any content you upload or generate. All processing occurs in real-time without permanent storage on our systems.

Unrestricted Usage Rights: You may use, reproduce, modify, publish, distribute, and commercialize any content you generate through our platform without restriction or royalty obligations to AI Free Forever.

Platform Role: AI Free Forever functions solely as a technology platform and processing intermediary. We claim no ownership rights over content you upload or generate.

5.2 Platform Content and Technology

Site Ownership: All content, features, and functionality of the Site itself, including but not limited to software, text, displays, images, video, audio, design, presentation, selection, and arrangement, are owned by AI Free Forever, Quick Flip Services, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Limited License to Use Site: We grant you a limited, non-exclusive, non-transferable license to access and use the Site solely for your personal, non-commercial use, subject to these Terms of Use.

6. DMCA/Copyright Policy

AI Free Forever respects copyright law and expects users to do the same. We maintain a policy that includes the removal of any infringing material from our services and the termination, in appropriate circumstances, of users who are repeat infringers.

Copyright Infringement Claims: If you believe that content on our Site infringes a copyright that you own or control, you may file a DMCA takedown notice by contacting us at:

10. Termination

Termination Rights: We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Effect of Termination: Upon termination, your right to use the service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

11. Governing Law and Dispute Resolution

Governing Law: These Terms shall be interpreted and governed by the laws of the Netherlands, without regard to its conflict of law principles.

Jurisdiction: Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the the Netherlands.

Waiver of Jury Trial: You and AI Free Forever hereby waive any constitutional and statutory rights to go to court and have a trial in front of a judge or a jury.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
